Terms of Service

These Terms of Service govern your use of the Absenca platform. By creating an account or using our service, you agree to these terms.

1. Acceptance of Terms

By accessing or using Absenca, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using Absenca on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Service Description

Absenca is a cloud-based leave management platform that helps organizations track employee absences, manage leave balances, handle approval workflows, and generate reports. The service is provided as-is and we continuously improve it.

3. Accounts & Access

You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information during registration and keep it updated. You must notify us immediately of any unauthorized access to your account.

4. Subscription & Billing

Absenca offers free and paid plans. Paid subscriptions are billed monthly or annually via Stripe. You may upgrade, downgrade, or cancel your subscription at any time. Upon cancellation, your access continues until the end of the current billing period. Refunds are not provided for partial billing periods.

5. Data Ownership

You retain full ownership of all data you input into Absenca. We do not claim any intellectual property rights over your content. You grant us a limited license to process your data solely to provide the service. Upon account termination, you may export your data before deletion.

6. Acceptable Use

You agree not to: use the service for any unlawful purpose; attempt to gain unauthorized access to our systems; interfere with the service's operation; transmit malware or harmful code; resell the service without written permission; or use the service to store data unrelated to leave management.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors beyond our control, including third-party service outages.

8. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account if you violate these terms. Upon termination, you have 30 days to export your data before it is permanently deleted.

9. Limitation of Liability

To the maximum extent permitted by law, Absenca's total liability for any claim related to the service shall not exceed the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

10. Governing Law

These terms are governed by the laws of the Republic of Kosovo. Any disputes shall be resolved in the courts of Pristina, Kosovo. For EU consumers, this does not affect your rights under mandatory consumer protection laws of your country of residence.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated at least 30 days before taking effect via email or in-app notification. Continued use after changes constitutes acceptance.
