Birthday Leave Policy: Template and How to Run It (Weekends, Part-Timers, New Joiners)
A birthday leave policy gives each employee one extra paid day off for their birthday, usually taken on the day or within the birthday month, moved to the next working day if it falls on a weekend, and pro-rated for part-timers. Free template included.
A birthday leave policy gives each employee one extra paid day off for their birthday, on top of their normal holiday allowance. The simplest version that works: one paid day, taken on the birthday or any working day in the same month, moved to the next working day if the birthday falls on a weekend or public holiday, and pro-rated for part-timers.
Is birthday leave a legal requirement?
No. Birthday leave is a contractual perk, not a statutory right, as of 2026.
- UK: almost all workers get 5.6 weeks of statutory paid holiday (28 days for a five-day week). GOV.UK says an employer "can choose to offer more leave than the legal minimum", and that extra leave can come with its own conditions, such as a qualifying period of employment.
- US: the Department of Labor says the Fair Labor Standards Act "does not require payment for time not worked, such as vacations... or holidays". Paid time off, including a birthday day, is a matter of agreement between employer and employee.
So you decide the rules. The catch is that once a perk is written into contracts or a handbook, people treat it as part of their package, so write it down clearly from day one. Rules vary by country and state, so check the official source for where your people work.
Which birthday leave option should you choose?
There are three common designs. Pick one and say so in writing.
| Option | How it works | Good for | Watch out for |
|---|---|---|---|
| On the day | The day off is the birthday itself | Small teams, simple rules | Weekend and holiday birthdays need a fallback; clashes when two people share a date |
| Within the birthday month | Any working day in the calendar month of the birthday | Most teams; lets people pick a long weekend | Month-end birthdays have fewer options left |
| Floating window | Any working day within, say, 2 weeks either side, or any time in the year | Shift teams, customer-facing roles | It starts to look like an extra holiday day, which weakens the "birthday" feel |
If you also want to cover religious or cultural days, a floating day works better than birthday leave; see our floating holiday policy guide.
What happens if a birthday falls on a weekend?
Decide this up front, because it's the most common question you'll get. The usual rules are:
- Next working day: a Saturday or Sunday birthday moves to Monday.
- Nearest working day: Saturday moves to Friday, Sunday to Monday.
- Any day in the month: the problem disappears, which is a good reason to choose the month option.
Apply the same rule when the birthday lands on a public holiday or during the Christmas shutdown. For shift workers whose "weekend" is a Tuesday, define it as "a day you're not scheduled to work" rather than Saturday or Sunday.
Leap-day birthdays (29 February): say that in non-leap years the birthday counts as 28 February (or 1 March). One line saves an awkward conversation.
How does birthday leave work for part-timers?
In the UK, GOV.UK says part-time workers should get the same treatment as full-timers for holidays and benefits, and that some benefits are applied pro rata. An employer can only treat part-timers differently with an objective justification. That gives you two fair approaches:
- Pro rata in hours: a full day for someone working 7.5 hours a day is 7.5 hours; a part-timer who works 4-hour days gets 4 hours on a working day.
- A working day, whatever its length: the employee takes their birthday on (or moves it to) a day they normally work.
What doesn't work is giving the perk only to people whose birthday falls on a day they're scheduled. A part-timer who works Monday to Wednesday would miss out four years in seven. Use the "next working day" rule for them too.
If you need the maths for part-time allowances generally, see how to calculate pro-rata holiday entitlement.
Do new joiners get birthday leave?
You choose. Common rules:
- Eligible from day one. Simplest, and the friendliest welcome.
- Eligible after probation or a qualifying period, such as three months. GOV.UK confirms extra leave above the statutory minimum can have a qualifying period.
- Eligible if the birthday falls after the start date, so someone joining in June with a March birthday waits until next March.
Leavers: say whether an unused birthday day is paid out when someone leaves. Most policies say no, because the day is a use-it-or-lose-it perk rather than accrued holiday, but put it in writing. Statutory holiday is a different matter; see being paid for unused holiday when leaving a job.
What are the common birthday leave pitfalls?
- Folding it into annual leave. If birthday leave is just a day added to the general allowance, it gets used for anything and nobody notices the perk. Track it separately.
- No expiry. Without a "use it in the month" or "use it by year end" rule, days pile up and become an unofficial carry-over.
- Making people disclose their birthday. Some people don't celebrate birthdays, for religious or personal reasons. Let them take the day as a personal day without explaining, or opt out.
- Team clashes. Two people in a four-person support team with birthdays the same week will both want it. Normal approval rules apply; the month option gives room to move.
- Unequal rules. Different rules for different groups (office vs. remote, full-time vs. part-time) invite complaints. One policy, applied to everyone.

Birthday Leave Policy
1. Purpose. [Company] gives every employee one paid day off to celebrate their birthday. This is in addition to annual leave and public holidays.
2. Eligibility. All employees are eligible [from their first day / after completing [3 months] of service]. The day can be taken in the first birthday month after eligibility begins.
3. Entitlement. Full-time employees receive one paid working day. Part-time employees receive one paid working day of their normal contracted hours [or: a pro-rata amount of [7.5] hours].
4. When to take it. The day can be taken [on the birthday / on any working day in the calendar month of the birthday / within [14] days before or after the birthday].
5. Weekends and public holidays. If the birthday falls on a non-working day, a public holiday or a company closure day, the employee can take the [next working day / any working day in the same month].
6. 29 February birthdays. In non-leap years the birthday is treated as [28 February].
7. How to request it. Request it through [leave system] as "Birthday Leave" at least [7] days in advance. Normal approval rules apply, and managers will try to approve all birthday requests.
8. Use it or lose it. Birthday leave can't be carried over, swapped for pay, split into half days [unless approved] or paid out when leaving.
9. Privacy. Employees don't have to say why they take the day, and birthdays are only shared with the team if the employee agrees.
10. Changes. [Company] may review this policy each year and will give [one month's] notice of any change.
Pair it with your annual leave policy template so both read the same way.
How do you track birthday leave as its own leave type?
Set it up as a separate leave type, not a top-up to annual leave. That keeps the annual leave balance honest and shows how many people actually use the perk. The settings to configure:
| Setting | Value |
|---|---|
| Name | Birthday Leave |
| Allowance | 1 day per leave year |
| Paid | Yes |
| Carry-over | 0 days |
| Maximum per request | 1 day |
| Minimum notice | Your notice period, e.g. 7 days |
| Available during probation | Matches your eligibility rule |
In Absenca each leave type has these settings (allowance per year, paid or unpaid, carry-over cap, minimum notice, maximum length per request, and whether it can be taken during probation), so birthday leave sits next to annual leave with its own balance and colour on the team calendar. On the Free plan (up to 10 people) you get two leave types, so birthday leave would take the second slot; Pro allows up to 20.
FAQ
Can I take my birthday leave on a different day?
Only if your policy says so. Under the "within the month" or floating option, yes; under "on the day", only when the birthday falls on a non-working day.
What if my birthday falls during my holiday?
Most policies let you keep the annual leave day and take birthday leave instead for that date, so the holiday day goes back to your balance. Write this into the policy.
Can a company take birthday leave away?
As it's a contractual perk, removing it usually means changing the terms people agreed to, so give notice and explain why. Rules vary by country, so check the official guidance where your team works.
